This text explores the concept of inalienable human rights, examining their fundamental nature and historical trajectory. Although the idea of natural rights lacks internal philosophical integrity and may appear to be a remnant of declining metaphysics, it maintains its significance in modern society. The paper highlights the paradox where, despite Nietzsche's diagnosis of the devaluation of values and the prevalence of intellectual relativism, these rights remain resilient within both public consciousness and political circles. This persistence is attributed primarily to their perceived indispensability in current social structures. The author traces the roots of this phenomenon from Ancient Greece and the prophetic traditions of Israel to the formative influence of the Reformation in England and the Netherlands. However, the classical form of human rights was firmly established only in connection with the American and French Revolutions. The analysis seeks to explain why this construct retains its authority even in an era dominated by skepticism and historical contingency.

[Nezadatelnost lidských práv – 1]
Myšlenka nezadatelných, eventuelně „přirozených“ lidských práv má rozmanitou podobu u různých autorů i v obecném použití. Přísně vzato jí chybí vnitřní integrita, ale také hlubší filosofický základ. Přesto si podržuje svou závažnost, a to – jak se zdá – nikoli svou vnitřní přesvědčivostí, nýbrž spíše pro svou nenahraditelnost resp. protože nemáme k dispozici vhodné alternativy. Tato myšlenka je navíc paradoxně provázena jistou historickou fakticitou, která si sama zaslouží naší pozornosti. Navzdory tomu, že se jeví jako jeden z posledních pozůstatků upadající tradiční metafyziky a že by proto sama měla být dějinně odsouzena k zániku, a navzdory tomu, že – podle Nietzschovy diagnózy – odkazuje j „hodnotám“, které by měly být „odhodnoceny“ a znehodnoceny, udržuje se stále nejen v obecném povědomí široké veřejnosti, ale zdá se mít značnou schopnost rezistence dokonce uprostřed všeobecného relativismu a skepticismu intelektuálních a politických kruhů. Ačkoliv některé její kořeny sahají až do starověku (zejména do doby sofistů a také Sókratovy, ale vedle zdrojů řeckých nesmíme zapomínat ani na zdroje prorocké tradice starého Izraele), její klasickou podobu najdeme – po jistých nábězích spíše filosofické a ideologické povahy např. v Holandsku a v Anglii, inspirovaných především reformačním návratem k některým biblickým pramenům – teprve v úzké dějinné spojitosti s americkou a pak francouzskou revolucí.
